2. International Humanitarian Law Student Writing Competition

American University Washington College of Law Center for Human Rights & Humanitarian Law (Center), the American Society of International Law’s Lieber Society (ASIL), and theAmerican Red Cross International Humanitarian Law team are pleased to announce the International Humanitarian Law (IHL) Student Writing Competition. The Competition seeks submissions of academic papers on the topic of international humanitarian law (IHL) from students currently enrolled in a law degree program in the United States or abroad. The purpose of the Competition is to enhance scholarship and deepen understanding among students in this important area of international law.

The theme of the 2015 Competition is “The Intersection of International Humanitarian Law and Gender.” Papers should focus on ways in which IHL intersects with gender issues, such as the role of women as combatants, the gendered use of sexual violence during times of armed conflict, the impact of  gender stereotyping on international humanitarian law, etc.

3. Research Participants Needed for LGBTIQ Study

Would you like to participate in a research project concerning LGBTIQ, questioning and non-gender binary experiences of bullying and harassment in tertiary spaces. A new study is looking to interview undergraduate students at Monash as part of a pilot study.

The purpose of this study is to investigate who within the LGBTIQ student community experiences harassment and bullying in a tertiary setting; and determine what impacts this may have on LGBTIQ students’ access to supportive educational outcomes.

It is hoped that a greater understanding of LGBTIQ experiences of violence in university settings will allow further exploration into how such intolerance can be combatted to facilitate an increased understanding of the needs of LGBTIQ youth.

LAW 5440 International Commercial Dispute Resolution Advocacy

The unit will focus on interest-based negotiation and advocacy skills in the context of commercial, including cross-border, disputes.

The unit examines the theory and practices of mediation and negotiation as dispute resolution processes, using the Harvard model of principled (interest-based) negotiation. The focus is effective negotiation advocacy and collaborative problem-solving to progress towards settlement, using theory sessions, role plays and interactive exercises.

The unit provides a highly relevant and entirely transferable skill set for legal practitioners and for any professional wanting to strengthen their effectiveness in commercial negotiation. The unit is designed to give students practical skills in the area of commercial negotiation advocacy, in the context of the increasing use of alternative dispute resolution in all jurisdictions.

On successful completion of this unit, students will:

• have a comprehensive understanding of commercial negotiation strategies and approaches;

• possess a sound understanding of, and have gained some practical experience in the practice of interest-based negotiation within a mediation process;

• be able to explain and respond to theoretical and practical issues raised by clients in commercial mediation and alternative dispute resolution settings.

Students who complete this unit have the opportunity to be selected to represent Monash University at the International Chamber of Commerce (ICC) Commercial Mediation Competition, taking place in Paris in February 2016. Selection will take place following the completion of the unit.

Extraordinary legislation is often resorted to as a means of protecting public safety. Such legislation inevitably draws the courts into the spotlight. There is much commentary about international criminal trials, and pre-trial considerations such as capture and decisions to prosecute or not. But there is very little commentary on what happens to alleged international criminals after a trial. It seems States are only interested in ‘fighting impunity’ and ignore post-trial justice.

What happens to those who have been acquitted and those who have served their sentence? Such people are often denied refugee status, creating a category of international outlaws. And what is the interplay between national and international criminal justice where former defendants can be prosecuted nationally after having been tried internationally? This is not only a question of double jeopardy – international trials are unable to cope with all elements of mass crimes, so there will always, perhaps, be an outstanding allegation that can be dealt with at the national level.

Bio: Elies van Sliedregt is Professor of Criminal Law at Vrije Univsiteit Amsterdam, Director of the Centre for International Criminal Justice and Dean of the Faculty of Law.  She has held visiting fellowships in Cambridge, Oxford, Bologna, and at the University of New South Wales, Sydney.  She was a visiting professional with Chambers at the International Criminal Court (ICC) in the Summer of 2010 and fellow-in-residence at the Netherlands Institute for Advance Studies in the Humanities and Social Sciences for the KNAW (NIAS) in 2011. Van Sliedregt is senior editor of the Leiden Journal of International Law and member of the Royal Holland Society of Sciences and Humanities.  Van Sliedregt has published extensively in the field of international, European and comparative criminal law.

2. Indonesian Enrichment and Research Program

About the program

The Indonesian Enrichment and Research Program (‘the Program’) gives students the opportunity to -participate alongside a Monash University Faculty of Law team in Indonesia to build capacity of university and civil society organisations (CSOs) family law legal aid clinics across Indonesia.

The Faculty of Law is working in partnership with the Australia Indonesia Partnership for Justice (AIPJ), CSOs and 12 Indonesian state universities to provide free legal assistance focussing on realising the rights of Indonesians to obtaining legal identity, particularly for women who are poor, vulnerable children and people with disabilities. The university and CSOs legal aid clinics teach law students and paralegals practical legal skills so that they are able to assist justice seekers to access the district and religious courts and navigate through the system of birth/marriage registration.

Students will have the opportunity to participate in clinical legal education meetings, workshops and site visits to different organisations in Indonesia.

The Program runs for 14 days in November/December 2015 (exact dates are to be confirmed) and airfare, travel and accommodation will be paid for by the Faculty of Law.

5. The Monash LSS Presents: Gender Identity and the Law

Gender identity describes a person’s own experience, understanding of, and identification with being male, female, both, neither or otherwise. Many people identify with the gender they were assigned at birth, and many others face discrimination in the law and throughout society for having a gender identity that may be different to the one given at birth. This seminar will provide the opportunity to learn more about the discrimination that occurs within our legal system pertaining to gender identity.

These issues will be explored by our panel of guest speakers from:  Transgender Victoria, an organisation that seeks to achieve justice, equality and quality health and community service provisions for transgender people, their partners and families;  The Equal Opportunity and Human Rights Commission, which seeks to promote the rights and responsibilities in the Victorian Human Rights and Responsibilities Charter; and  Ygender, a peer led social support and advocacy group for trans/gender diverse young people.
