6. Vice-Chancellor Public Debate 2015

Join us to hear six public figures debate the ever contentious issue: ‘That we should privatise the ABC’.

The Australian Broadcasting Corporation (ABC) has provided Australians with high quality and independent broadcasting since 1932. There is no doubt that the ABC has a special place in our hearts as our national broadcaster. But in today’s day and age, does the raison d’etre for the ABC still exist? Or has it become an unnecessary drain on the taxpayer dollar, one which the government and the Australian public should consider letting go?

The Monash Association of Debaters has the great pleasure of inviting you to the 2015 Vice Chancellor’s Public Debate.

The debate will be moderated by the Pro-Vice Chancellor – Professor David Copolov.

1. 21st Lucinda Lecture – “Of lions and squeaking mice in anxious times”

By Emeritus Professor H P Lee

From time to time most countries will encounter threats to the security of the state polity, ranging from a wartime situation to the contemporary terror threats.

Extraordinary legislation is often resorted to as a means of protecting public safety. Such legislation inevitably draws the courts into the spotlight. Perilous times present
the courts with a dilemma. This lecture seeks to canvass that dilemma and the lessons that can be learnt from past judicial experience in Australia and some selected jurisdictions.

3. The Castan Centre for Human Rights Law/King & Wood Mallesons Annual Lecture

Death by Algorithm – the advent of “killer robots” by Professor Christof Heyns

Public event – all welcome

Professor Christof Heyns, UN Special Rapporteur on extrajudicial, summary or arbitrary executions.

The use of force, in war and in peace, is increasingly impersonal. Unmanned systems are here to stay.

We have become all too familiar with the first generation of these unmanned systems: remotely piloted aircraft. Here the human is no longer necessarily physically present on the battlefield. An operator half-way around the world presses the button and a Hellfire missile is released from an armed drone. At the same time a further generation of unmanned systems is emerging, where human beings will not only be physically absent from the delivery of force, but also pshycologically, in the sense that computers and not humans will take the final decision on its release.

This development raises far-reaching legal and ethical questions. How good will they be at targeting? But also – should they be allowed to do this? Right to life and issues of dignity arise. But – does it really matter what we think about it? Have we not entered a new era where machines will take the important decisions?

4. Public Lecture – Elies van Sliedregt

The Castan Centre for Human Rights Law and Holding Redlich present

Elies van Sliedregt, Professor of Criminal Law at Vrije Universiteit Amsterdam, Director of the Centre for International Criminal Justice and Dean of the Faculty of Law

Date: Thursday 3 September 2015

Time: 6.00pm – 7.15pm

Venue: Monash University Law Chambers, 555 Lonsdale Street, Melbourne

RSVP: castan.centre@monash.edu or 03 9905 3327

There is much commentary about international criminal trials, and pre-trial considerations such as capture and decisions to prosecute or not. But there is very little commentary on what happens to alleged international criminals after a trial. It seems States are only interested in ‘fighting impunity’ and ignore post-trial justice.

What happens to those who have been acquitted and those who have served their sentence? Such people are often denied refugee status, creating a category of international outlaws. And what is the interplay between national and international criminal justice where former defendants can be prosecuted nationally after having been tried internationally? This is not only a question of double jeopardy – international trials are unable to cope with all elements of mass crimes, so there will always, perhaps, be an outstanding allegation that can be dealt with at the national level.

Bio: Elies van Sliedregt is Professor of Criminal Law at Vrije Univsiteit Amsterdam, Director of the Centre for International Criminal Justice and Dean of the Faculty of Law.  She has held visiting fellowships in Cambridge, Oxford, Bologna, and at the University of New South Wales, Sydney.  She was a visiting professional with Chambers at the International Criminal Court (ICC) in the Summer of 2010 and fellow-in-residence at the Netherlands Institute for Advance Studies in the Humanities and Social Sciences for the KNAW (NIAS) in 2011. Van Sliedregt is senior editor of the Leiden Journal of International Law and member of the Royal Holland Society of Sciences and Humanities.  Van Sliedregt has published extensively in the field of international, European and comparative criminal law.
