1. Book Launch – “The Good Lawyer”

To be launched by Mr Michael McGarvie, Legal Services Commissioner and CEO, Legal Services Board Victoria.

“The Good Lawyer” explores the ethical and professional challenges that confront people who work in the law – or are considering it – and offers principled and pragmatic advice about how to overcome such challenges.

This book takes a holistic approach that begins with your innate humanity. It urges you to examine your motives for seeking a career in law, to foster a deep understanding of what it means to be ‘good’, and to draw on your virtue and judgement when difficult choices arise, rather than relying on compliance with rules or codes.

The Good Lawyer analyses four important areas of legal ethics – truth and deception, professional secrets, conflicts of interest, and professional competence – and explains the choices that are available when determining a course of moral action. It links theory to practice, and includes many examples, diagrams and source documents to illustrate ethical concepts, scenarios and decision making.

La Trobe and Monash University present the launch of Human Rights in Closed Environments edited by Bronwyn Naylor, Julie Debeljak and Anita Mackay and published by Federation Press.

Professor Gillian Triggs, President of the Australian Human Rights Commission will officially launch the book.

Human Rights in Closed Environments stems from an Australian Research Council Linkage grant examining the implementation of human rights in six specific Australian ‘closed environments’ – prisons; police cells; forensic psychiatric institutions; closed mental health units; closed disability units; and immigration detention centres.

The publication highlights rights concerns common across the different types of environments, such as the vulnerability of persons held in detention the tension between respect for rights and safety concerns, and securing a human rights culture in the context of significant power imbalances. It also draws comparisons between the same closed environments in different jurisdictions, examining the ‘value add’ of formal rights instruments.

Finally, it considers the role of external monitoring mechanisms (such as, Ombudsmen and Human Rights Commissions) in securing rights respecting environments, in the context of Australia signing, but not yet ratifying, the Optional Protocol to the Convention Against Torture (OPCAT).

The role of an Ombudsman is to redress the imbalance of power between individual and state – a fundamentally unfair relationship. With jurisdiction over more than 1,000 public bodies, the Victorian Ombudsman Deborah Glass will reflect on fairness and the role of her office in ensuring it.

The need for an independent specialist mental health complaints body was identified from community consultations and feedback in the context of mental health legislative reforms consultations. The Mental Health Complaints Commissioner was established under the Mental Health Act 2014, and commenced operation on Tuesday 1 July, 2014. Lynne Coulson Barr is Victoria’s first Mental Health Complaints Commissioner and will provide an outline of the role of the office and approaches to resolution of complaints about mental health services.

All too often mediation is the default position for parties and lawyers wanting to use ADR to resolve a dispute. However, there are many different ADR models, and some maybe more appropriate to the nature of the dispute and parties than mediation. This seminar will provide insight into the use of Early Neutral Evaluation (ENE) in a variety of jurisdictions around the world and identify when it might be appropriate to use, and the pros and cons of broadening our ADR options.

5. National Law Honours Student Conference

The National Law Honours Student Conference provides graduating LLB and JD students and recent graduates with the opportunity to present their law honours research, senior research thesis or comparable major research project in an academic setting. Session chairs in the students’ research field will offer constructive feedback and advice, including possible publication. There is a prize for best presentation, attendance is free and lunch and drinks are provided. A keynote address will be provided by Ass Prof Katherine Biber, of UTS Law Faculty, and the Hon Kevin Lindgren AM QC, former Federal Court Judge, will be the distinguished chair of prize-giving. Attendance is by invitation only upon submission of the paper abstract.

1. 16th National Family Law Conference 2014

This year’s National Family Law conference will take place from Tuesday 7 until Friday 10 October at the Hilton Sydney and has a truly eclectic program which is sure to be not only interesting for students, but also educational and beneficial for studies and resumes.

There are currently 800 registered delegates and this number is increasing
every day. The conference will be using an app instead of a printed program, and the app is available on the app store now for download. To look at the conference program and speakers who will be presenting this year, type in FL14 into the app store on either your Apple or Android device and download.

There is a heavily discounted student rate of $250 for the day and many social functions on offer. In particular, the New and Young Lawyer’s Evening at Paddington’s Bowls Club, Thursday 9 October. 1. 16th National Family Law Conference 2014

This year’s National Family Law conference will take place from Tuesday 7 until Friday 10 October at the Hilton Sydney and has a truly eclectic program which is sure to be not only interesting for students, but also educational and beneficial for studies and resumes.

There are currently 800 registered delegates and this number is increasing

All too often mediation is the default position for parties and lawyers wanting to use ADR to resolve a dispute. However, there are many different ADR models, and some maybe more appropriate to the nature of the dispute and parties than mediation. This seminar will provide insight into the use of Early Neutral Evaluation (ENE) in a variety of jurisdictions around the world and identify when it might be appropriate to use, and the pros and cons of broadening our ADR options.

The National Law Honours Student Conference provides graduating LLB and JD students and recent graduates with the opportunity to present their law honours research, senior research thesis or comparable major research project in an academic setting. Session chairs in the students’ research field will offer constructive feedback and advice, including possible publication. There is a prize for best presentation, attendance is free and lunch and drinks are provided. A keynote address will be provided by Ass Prof Katherine Biber, of UTS Law Faculty, and the Hon Kevin Lindgren AM QC, former Federal Court Judge, will be the distinguished chair of prize-giving. Attendance is by invitation only upon submission of the paper abstract.

6. VADR: Metal Health Complaints Commissioner

You are cordially invited to a VADR CPD event will take place on Tuesday 28 October, 2014 when Lynne Coulson Barr, the new Mental Health Complaints Commissioner will speak on the topic “New approaches to resolving mental health services complaints.”

The need for an independent specialist mental health complaints body was identified from community consultations and feedback in the context of mental health legislative reforms consultations. The Mental Health Complaints Commissioner was established under the Mental Health Act 2014, and commenced operation on Tuesday 1 July, 2014. Lynne Coulson Barr is Victoria’s first Mental Health Complaints Commissioner and will provide an outline of the role of the office and approaches to resolution of complaints about mental health services.

2. Beating the Law Blues

Being a law student at university presents its own unique challenges and hardships. One of the most damaging of these can be challenges to your emotional health – particularly depression and other mental illnesses and conditions. Among all the pressures of performing academically and finding a professional future, the compromise of psychological health is perhaps inevitable. The Law Ambassadors present “Beating the Law Blues” a social event designed to raise awareness of the particular issues that law students face regarding their psychological well-being. The charity that we are supporting is the Tristan Jepson Memorial Foundation, an organisation that focuses on the mental health of the legal community. The central focus will be an intimate musical concert with provided refreshments and snacks such as fairy floss, hot dogs and other goodies. Invite your friends and enjoy yourself as we remind ourselves of the importance of being healthy and thinking positively.

4. MUNash 2014

Are you interested in international affairs, public speaking, and negotiating? Looking for something fun to do in your mid-semester break? Then you should participate in MUNash: Monash University Model United Nations Conference.

MUNash will run from Monday 29 September until Wednesday 1 October (during the mid-semester break) at the Caulfield campus, and is organised by the Monash International Affairs Society and Orion College.

A Model United Nations is a simulation of the UN General Assembly and other multilateral bodies. In a Model UN, students step into the shoes of ambassadors from UN member states to debate current issues on the organisation’s agenda. While playing their roles as ambassadors, student “delegates” make speeches, prepare draft resolutions, negotiate with allies and adversaries, resolve conflicts, and navigate the Model UN rules of procedure – all in the interest of mobilising international cooperation to resolve problems that affect countries all over the world.

This year, there are five different committees available.

Committees which are open to all participants (no experience or special knowledge required):

  • Second General Assembly (economic and financial)
  • Sixth General Assembly (legal)
  • Human Rights Council

Committees which are only open to participants with special experience:

  • Security Council (MUN experience required)
  • International Criminal Court (MUN or mooting experience required)

Your ticket includes participation in the conference, entry into the night time events, and morning tea, lunch and afternoon tea on all three days. You will have ample opportunity to mingle and network with delegates from all committees.

1. 20th Lucinda Lecture – Legislative Intention – Clayton Campus

Presented by: The Honourable Justice Stephen Gageler, the High Court of Australia

Stephen John Gageler was appointed to the High Court in October 2012. At the time of his appointment he was Solicitor-General of Australia. He is a graduate of the Australian National University and has post-graduate qualifications from Harvard University. He was admitted as a barrister of the Supreme Court of New South Wales in 1989 and was appointed Senior Counsel in 2000. Before his appointment as Solicitor-General in 2008, he practised as a barrister extensively throughout Australia, principally in constitutional law, administrative law and commercial law.

5. LSS Cabaret Night

The LSS in conjunction with the legal production group Bottled Snail will be hosting a charity cabaret night. The show is titled ‘The Secret Life of a Lawyer’ and uses song, comedy and theatre to present a light-hearted look at the idiosyncrasies of life in the legal community. All the while, the show will promote a powerful message about looking out for the wellbeing of yourself and others. Proceeds from ticket sales will be donated to the Tristan Jepson Memorial Foundation, a charitable organisation set up to raise the profile of depression, anxiety and other mental illnesses within the legal fraternity.
