Enrol in Monash Law’s new unit: ‘Issues in Transnational Dispute Resolution’

Monash Law is offering a unique opportunity to take your knowledge of transnational dispute
resolution to the next level.

Issues in Transnational Dispute Resolution (LAW 5475) is a brand new unit offering professionals the opportunity to learn from former Supreme Court judges who draw upon a lifetime of experience deciding complex commercial cases, as well as their current practise as international commercial arbitrators.

The unit is taught by former Victorian Chief Justice Marilyn Warren, former Justice Clyde Croft (who was judge in charge of the Arbitration List in the Commercial Court of the Supreme Court of Victoria), and Dr Drossos Stamboulakis.

The unit focuses on issues that arise for consideration where commercial disputes involve parties in more than one country and where there are inhibitions in seeking to resolve disputes in the national courts of any particular country, much less the country some only of the disputants.

This brand new unit is offered in June 2021. Enrolments are open now.

About your teachers

Professor the Hon Marilyn Warren AC QC was Chief Justice of Victoria (2003-2017). While a judge of the Supreme Court of Victoria (1998-2003) she sat as the Judge in Charge of the Commercial List and the Corporations List (now combined as the Commercial Court). Whilst on the bench, Professor Warren sat in all jurisdictions, trial and appellate, and extensively in commercial cases. She presently sits as a domestic and international commercial arbitrator. She is a member of the Dawson Chambers Senior Arbitrator Group at the Victorian Bar.

Professor the Hon Clyde Croft AM SC was a Commercial Court Judge of the Supreme Court of Victoria from 2009 to 2019 in charge of a General Commercial List, the Arbitration List, the Taxation List and Retail Leases Act appeals. Professor Croft was also an international arbitrator – “door tenant” – at Falcon Chambers, London, and is now a member of Falcon Chambers as an international arbitrator and mediator. He is also practising in these capacities based at Dawson Chambers, Melbourne.

Dr Drossos Stamboulakis’ teaching and research interests span international private law, with a focus on commercial dispute resolution, private international law, contract law, and private environmental regulation and governance. He completed his doctorate at the University of Melbourne. He also holds a European Masters in Law and Economics from Rotterdam, Bologna and Haifa Universities, and an LLB (1st Class) and BCom (Economics) from Monash University. He is admitted to practice, and has worked previously: at King & Wood Mallesons, in the arbitration and commercial litigation teams; at the Hague Conference on Private International Law; and, as an Associate to the Hon. Justice Croft in the Commercial Court of the Supreme Court of Victoria

4. Book Launch – The UN Commission on Human Rights: ‘A Very Great Enterprise’

When the General Assembly established the Human Rights Council in 2006, it asked for a review of its ‘work and functioning’ five years after its establishment. The will to elevate the Council to a Principal Organ of the UN did not materialise by 2011; in 2011 the Council put off that decision by another 10 to 15 years. The Council should review its status between now and 2026.

3. Job Opportunities: Associate and Research Associate to the Hon Justice Pritchard

Applications are invited for the positions of Associate and Research Associate to the Hon Justice
Pritchard, President of the State Administrative Tribunal, to commence in January 2022.
The successful applicants will be based at the State Administrative Tribunal but will also assist Justice
Pritchard in relation to matters in the Court of Appeal.
Both positions are offered for a period of 12 months. At the discretion of the Court, the tenure of this
position may include a subsequent two weeks.

Prospective applicants should possess the following attributes:

 A law degree (completed as at January 2022);
 A high level of academic achievement (Honours or equivalent is desirable but not essential);
 High-level research and analytical skills;
 Excellent verbal, interpersonal and written communication skills; and
 Editorial skills are an advantage.

5. CLARS & Economics Session – The Google/Fitbit Merger: Where Do We Stand? (30 March)

If Google’s acquisition of FitBit is approved, what does this mean for personal data and consumers?

The European Commission and the U.S. DOJ have approved the controversial Google/Fitbit merger based on a static, conventional view according to which only limited issues arise from a merger of complements.

This presentation will suggest that there are unprecedented concerns in a merger case such as this one, which allows Fitbit’s data-gathering capabilities to fall in the hands of Google. Indeed, such a merger creates major risks of extension of monopoly power and consumer exploitation.

Digital healthcare is a major growth area, and the combination of Fitbit’s health data with Google’s other data creates unique opportunities for discrimination and exploitation of consumers in healthcare, health insurance and other sensitive areas. The approval of this merger would lead to market failure and monopolisation in digital healthcare.

Established in 1973, MSA Camps and Events is a volunteer leadership program that provides all Monash students with an opportunity to meet other students prior to Week 1.

2. LIV Young Lawyers Bootcamp – Preparing for Law School (15-18 Feb)

Law Institute of Victoria (LIV) Young Lawyers connects law students and those early in their legal career to the profession.

The Young Lawyers Bootcamp offers a series of FREE online workshops for students attending law school for the first time and for those of you in your earlier years of a law degree (JD or LLB).

The workshops, and future programs, focus on preparing law students for your formative years at law school while also providing support through mentoring, networking and the promotion of mental health and wellbeing.

For many attendees it will be your first opportunity to connect with your professional organisation and to hear from experts and learn from the experiences of fellow LIV Young Lawyers.

3. Startup Failure (Thurs 18 Feb)

Venture-backed startups famously “exit” by going public or selling to another company through an acquisition deal. A different path, however, is far more common – failure.

Despite the large amounts invested in venture-backed startups, and their high average rate of failure, these companies rarely use the formal Chapter 11 bankruptcy process that is embraced by distressed public companies seeking to preserving their going-concern value.

In this discussion, Professor Elizabeth Pollman (Pennsylvania Law School) will provide an account of startup failure, including:

  • Why bankruptcy law does not fit the needs of most distressed venture-backed startups
  • What we can learn from the rare exceptions and
  • How alternative mechanisms serve an important role in the venture capital ecosystem.

Nominations are now open for the Sir John Monash Medal for Outstanding Achievement.

The Sir John Monash Medal for Outstanding Achievement is awarded to a student who:

  • Has completed the academic requirements for the degree of Bachelor of Laws (Honours) and is eligible to graduate;
  • Is judged to have an excellent academic record; and
  • Has demonstrated a significant commitment to advancing the University’s goals of social justice, human rights and a sustainable environment.

You can self-nominate, nominate another student or get a nomination from a Monash staff member or a member of the community. Nominations close 5:00pm AEDT Friday 26 February 2021.

All nominations must include a letter explaining the reason for the nomination and a statement from the nominee addressing how he/she meets each of the eligibility criteria. Please also provide any supporting information which could be of use to the selection committee and permission from the student to have his or her academic records released to the committee.

1. Editorial Committee applications for the Monash University Law Review – Now open

The Monash University Law Review is the flagship academic journal of Monash Law. It is highly regarded by the legal profession and international law schools.

The 2021 Editors and Faculty Advisors are accepting applications from current LLB and JD students to join the Editorial Committee in 2021.

Committee members will receive training to complete 3–4 partial edits of an article during the course of the year. The time commitment per edit is approximately 10 hours. Involvement with the Review provides students with valuable practical skills in legal research, writing and editing, and is highly regarded by law firms and employers.

We are looking for highly committed students with strong time management skills, excellent attention to detail and close familiarity with the AGLC4. Applicants with at least one full year of study remaining will be preferred. Aboriginal and Torres Strait Islander students, those with a disability and students from under-represented backgrounds are strongly encouraged to apply, including those supported by Monash under the Equity definitions.

Monash Student Association’s Week 0 events and activities are now on!

Established in 1973, MSA Camps and Events is a volunteer leadership program that provides all Monash students with an opportunity to meet other students prior to Week 1.

The events we run are fun and inexpensive, with the aim of providing safe spaces where students can meet other students, who they may never have bumped into otherwise. Events and activities include:

2. LIV Young Lawyers Bootcamp – Preparing for Law School (15-18 Feb)

Law Institute of Victoria (LIV) Young Lawyers connects law students and those early in their legal career to the profession.

The Young Lawyers Bootcamp offers a series of FREE online workshops for students attending law school for the first time and for those of you in your earlier years of a law degree (JD or LLB).

The workshops, and future programs, focus on preparing law students for your formative years at law school while also providing support through mentoring, networking and the promotion of mental health and wellbeing.

For many attendees it will be your first opportunity to connect with your professional organisation and to hear from experts and learn from the experiences of fellow LIV Young Lawyers.

3. Startup Failure (Thurs 18 Feb)

Venture-backed startups famously “exit” by going public or selling to another company through an acquisition deal. A different path, however, is far more common – failure.

Despite the large amounts invested in venture-backed startups, and their high average rate of failure, these companies rarely use the formal Chapter 11 bankruptcy process that is embraced by distressed public companies seeking to preserving their going-concern value.

In this discussion, Professor Elizabeth Pollman (Pennsylvania Law School) will provide an account of startup failure, including:

  • Why bankruptcy law does not fit the needs of most distressed venture-backed startups
  • What we can learn from the rare exceptions and
  • How alternative mechanisms serve an important role in the venture capital ecosystem.
